Agreeing to these terms
These terms are an agreement between you and Derby Dashboard ("we" or "us") for using the website, app and family pages at derbydashboard.app (the "service"). By creating an account, signing in, or using a race or sign-up link, you agree to these terms and to our Privacy Policy. If you use the service for a pack, club, church or other group, you're agreeing for that group too, and you confirm you're allowed to.
Who can use it
You must be at least 18 to create an account or fill in the online sign-up form. Children take part as racers, but an adult enters their information. Keep your sign-in details to yourself, and tell us right away at support@derbydashboard.app if you think someone else has used your account. You're responsible for what happens under your account and for the helpers you invite.
Plans and payment
- Free costs nothing and has the limits shown on our pricing.
- Pack and Pack Plus are paid yearly, at the price shown when you sign up. Paid plans are set up by email for now.
- A paid plan runs through its paid-through date. If it isn't renewed, the pack goes back to Free: your events are kept, but paid features stop working.
- If you're not happy with a paid plan, email us within 30 days of paying and we'll refund it in full.
- We may change prices or what a plan includes. A price change takes effect at your next renewal, and we'll tell you before then.
Your race data
Everything you put into Derby Dashboard (rosters, photos, results and the rest) stays yours. You give us permission to store, copy and display it only as needed to run the service for you, for example syncing it to your helpers' devices, showing it on your big screens, and showing it on the family page when you turn that on.
You're responsible for the information you enter. In particular:
- Only add a child's name or photo if you're allowed to, and get a parent's permission before adding a photo.
- Remember that anyone you share a race link or code with can see what that link shows, including racers' names.
- Keep your own backups. The app can save a backup file of any event at any time.
Family links
Parents and spectators can use race and sign-up links without an account. If you use them, you agree to these terms too. Online sign-up only asks the race managers to add a racer. It doesn't guarantee a spot, and cars are still checked in at the race.
Acceptable use
Don't use Derby Dashboard to:
- break the law, or post anything hateful, harassing, sexual or otherwise inappropriate for a family event;
- upload information or photos you don't have the right to share;
- get into accounts, packs or events that aren't yours, or probe, overload or interfere with the service;
- copy, resell or rebuild the service, or collect data from it with automated tools; or
- get around plan limits, for example by creating extra packs to avoid the racer limit.
We may remove content or suspend an account that breaks these rules. Where it's reasonable, we'll tell you first.
Race results
Derby Dashboard is a tool to help you run your event. Results depend on how the race is run and judged, and the people running the race make the final call. We aren't responsible for disputes about results, awards or prizes.
Changes and availability
We're always improving Derby Dashboard and may add, change or remove features. We work hard to keep it running, and the app is built to keep racing on the laptop even when the internet drops. Still, we can't promise the service will always be available or free of errors.
Ending your use
You can stop using Derby Dashboard and delete your account or pack from Settings at any time. We may end or suspend access if you break these terms, or stop offering the service. If we stop offering it, we'll give paying customers at least 30 days' notice so they can download their events, and refund any unused time on a paid plan.
Disclaimers
The service is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement.
Limit on our responsibility
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for lost data, and our total responsibility for any claim about the service is limited to the amount you paid us in the 12 months before the claim, or $50 if you haven't paid us anything. Some places don't allow these limits, so they may not all apply to you.
Indemnity
If someone makes a claim against us because of information you entered or the way you used the service in breach of these terms, you agree to cover the reasonable costs of that claim.
Trademarks
Derby Dashboard isn't affiliated with or endorsed by Scouting America or Awana Clubs International. Pinewood Derby is a registered trademark of Scouting America. Awana is a registered trademark of Awana Clubs International.
Governing law
These terms are governed by the laws of the State of Washington, USA. Any dispute will be handled in the state or federal courts in Skagit County, Washington, unless the law where you live says otherwise. Before going to court, please email us so we can try to sort it out.
Changes to these terms
If we change these terms, we'll update the date at the top. For important changes, we'll tell account owners by email or in the app before they take effect. Using the service after that means you accept the new terms.
